Pour les propri\u00e9taires et gestionnaires, l\u2019enjeu est d\u00e9sormais concret : anticiper les obligations, les d\u00e9lais et le mod\u00e8le \u00e9conomique du projet.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Pour de nombreux sites, l\u2019\u00e9ch\u00e9ance de juillet 2026 impose d\u2019agir rapidement, car l\u2019audit, les autorisations, le raccordement et les travaux exigent souvent plusieurs mois.&nbsp;<\/p>\n\n\n\n<p><strong>Quels parkings sont concern\u00e9s ?<\/strong>&nbsp;<\/p>\n\n\n\n<p>Le dispositif vise les parkings ext\u00e9rieurs existants de plus de 1 500 m\u00b2. Le propri\u00e9taire est en principe responsable, sauf lorsque l\u2019exploitation rel\u00e8ve d\u2019une concession, d\u2019une d\u00e9l\u00e9gation ou d\u2019une autorisation d\u2019occupation.&nbsp;<\/p>\n\n\n\n<p>Les parkings de plus de 10 000 m\u00b2 doivent \u00eatre conformes au 1er juillet 2026, et ceux entre 1 500 et 10 000 m\u00b2 au 1er juillet 2028. Il faut donc qualifier rapidement la surface r\u00e9ellement concern\u00e9e et v\u00e9rifier les cas \u00e9ventuels d\u2019exemption ou de mutualisation.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Les petits parkings existants ne sont pas concern\u00e9s r\u00e9troactivement. En revanche, les projets neufs ou de r\u00e9novation lourde de plus de 500 m\u00b2 doivent int\u00e9grer d\u00e8s la conception des dispositifs d\u2019ombrage sur au moins 50 % de leur surface ainsi que la gestion des eaux pluviales.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Que demande concr\u00e8tement la loi ?<\/strong>&nbsp;<\/p>\n\n\n\n<p>La loi n\u2019impose pas n\u00e9cessairement de couvrir tout le parking de panneaux solaires. Elle exige d\u2019abord un niveau minimal d\u2019ombrage, compl\u00e9t\u00e9 par une production d\u2019\u00e9nergie renouvelable appr\u00e9ci\u00e9e selon le cadre en vigueur.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Le principe reste celui d\u2019un ombrage couvrant au moins 50 % de la surface concern\u00e9e. Depuis les \u00e9volutions l\u00e9gislatives de 2025, cette obligation peut, dans certains cas, combiner ombri\u00e8res photovolta\u00efques et solutions v\u00e9g\u00e9talis\u00e9es, avec un minimum photovolta\u00efque souvent pr\u00e9sent\u00e9 autour de 17,5 % de la surface totale.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Quelles sanctions en cas de non-conformit\u00e9 ?<\/strong>&nbsp;<\/p>\n\n\n\n<p>Les p\u00e9nalit\u00e9s peuvent atteindre :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>20 000 \u20ac par an pour les parkings entre 1 500 et 10 000 m\u00b2,&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>40 000 \u20ac par an au-del\u00e0 de 10 000 m\u00b2.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Les p\u00e9nalit\u00e9s peuvent atteindre 20 000 \u20ac par an entre 1 500 et 10 000 m\u00b2, et 40 000 \u20ac au-del\u00e0. D\u00e8s lors, diff\u00e9rer la d\u00e9cision peut co\u00fbter chaque ann\u00e9e sans cr\u00e9er de valeur, alors qu\u2019une mise en conformit\u00e9 bien con\u00e7ue peut produire de l\u2019\u00e9lectricit\u00e9 et am\u00e9liorer l\u2019usage du site.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Une ombri\u00e8re photovolta\u00efque prot\u00e8ge les v\u00e9hicules, am\u00e9liore le confort des usagers et peut soutenir l\u2019autoconsommation ou la revente d\u2019\u00e9lectricit\u00e9.&nbsp;&nbsp;<\/p>\n\n\n\n<p><strong>Une obligation qui peut devenir un levier \u00e9conomique<\/strong>&nbsp;<\/p>\n\n\n\n<p>Les \u00e9volutions de 2025 ont aussi s\u00e9curis\u00e9 le cadre d\u2019implantation : les r\u00e8gles locales d\u2019urbanisme ne peuvent plus faire obstacle de mani\u00e8re g\u00e9n\u00e9rale aux dispositifs pr\u00e9vus par la loi, m\u00eame si certaines contraintes techniques ou patrimoniales demeurent \u00e0 analyser.&nbsp;&nbsp;<\/p>\n\n\n\n<p>En parall\u00e8le, certaines zones d\u2019acc\u00e9l\u00e9ration des \u00e9nergies renouvelables permettent de simplifier les proc\u00e9dures et d\u2019am\u00e9liorer les conditions \u00e9conomiques des projets.&nbsp;<\/p>\n\n\n\n<p>Pour les entreprises, l\u2019int\u00e9r\u00eat devient strat\u00e9gique si le projet est abord\u00e9 comme un investissement :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>r\u00e9duction&nbsp;des co\u00fbts \u00e9nerg\u00e9tiques,&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>am\u00e9lioration&nbsp;de l\u2019image RSE,&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>valorisation&nbsp;du patrimoine immobilier.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><strong>Comment anticiper d\u00e8s maintenant ?<\/strong>&nbsp;<\/p>\n\n\n\n<p>Anticiper, c\u2019est d\u2019abord s\u00e9curiser un calendrier r\u00e9aliste, car l\u2019\u00e9tude, les d\u00e9marches administratives, le raccordement et l\u2019installation prennent du temps.&nbsp;&nbsp;<\/p>\n\n\n\n<p>La premi\u00e8re \u00e9tape consiste \u00e0 \u00e9tablir un diagnostic du site pour arbitrer la solution technique et la rentabilit\u00e9 attendue :&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>surface&nbsp;concern\u00e9e,&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>potentiel&nbsp;solaire,&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>possibilit\u00e9s&nbsp;de raccordement.&nbsp;&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Vient ensuite le choix du mod\u00e8le \u00e9conomique : investissement direct, tiers-financement ou partenariat avec un \u00e9nerg\u00e9ticien.
